legal-actions-against-fraud-zoommaker-or-fraud-fostering-kickstarter's Issues

There might be a predecessor company and finding it would proof the fraud.

I guess that the entire hardware is the leftover of some old production attempt that failed. Then the
scammer got hold of these remnants and invented a ridiculous cheap price to stage his fraud.
If someone would find some traces of this supposed original company, this would quickly proof the
fraud.

file criminal complaints in 3 countries to make prosecutors claim Zoomakers contact details from Kickstarter.

I can not file a criminal complaint at my local police station because i (of cause) had reduced my pledge to $1, so i have not suffered a loss.

But you other backers should print:

  1. your pledge,

  2. a copy of the Kickstarter rules (highlight the rule for transparency):

  1. this commen section and highlight every comment "no response":
  1. Comments who in vain had requested the contact details from Kickstarer:
  1. and the comments telling that last update was a deception because the photo was months old:
  1. My dispute with Kickstarter and that Zoommaker declined to tell his identity:

Then go to your local police and file a criminal complaint
urging the police to clam Zommmakers address from Kickstarter.

Everyone who suffered a $99+ loss should do this.

I am not your savior. Over the last years i have been enganged in many frauds to build an opposition and it has always failed BECAUSE 99% of all backers are "brain degenerated consumers" who don't care for their money anyway.

I am still here because i think crowdfunding to be an essential part of the evovling "information society". So i still dream that someday some people too will want to take action not because of their loss but for a better Kickstarter.

@all, add to the fraud list

@ALL, please add more frauds to this list so official https://github.com/RoboDurden/legal-actions-against-fraud-Zoommaker-or-fraud-fostering-Kickstarter/blob/main/todo/the%20fraud%20list.md grows and grows.

Simply search www.kickstarter.com/discover/advanced?category_id=16&sort=most_backed&seed=2684078 and have a quick look at the comment sections. It is normal that some backers have not received anything (because they gave a wrong address), but you will quickly learn how to identify another scam or failed campaign (which very likely will have entered the "scam zone").

The above search link is ordered by "Most Backed", so you can start with backer numbers less then those already posted here.

Only add campaigns from the Technology category !

Because this category has the highest fraud/failing rate ?

set Kickstarter a deadline to inform all backers of the fraudulent update #5

Thank you James Schayes and Jim Sims for contacting Kickster and having set them a deadlinie to provide you with the creators contact details. Your comments here are legally usable testimony if we indeed have to go against Kickstarther themselves.

There is a likewise step we should take now to later prove that Kickstarter has been a partner in crime. Those of you who agree to the following should again report this camaign to Kickstarer and copy the following or likewise text into your message:

After growing backer opposition this plain obvious fraud issued an update on 2020/11/30 stating that they had been busy assembling printers, the first 50 printers are almost done and will be shipped soon. But as proof they posted a photo from before the campaigns end that they had already posted on their Facebook page on 2020/10/12 !

In case they delete their old Facebook post, the following backer comments serve as witness accounts = legally usable testimony:

  • Jeremy Krepelka Superbacker: "This is the same picture from your Facebook page from months ago"

  • Victor Adrian M. Gonzales: "They posted an update but the pic uploaded is the same pic uploaded in their FB page last Oct 22...zzzz"

  • Dominique: "That picture is from your Facebook, from more than a month ago, Stop with your lies, we already know you are a scam"

  • Ryan Whitfield: "These are just some steel covers. If you have finished machines for packing, why wouldn't you photograph them???"

You Kickstarter allowed a fraudulent creator to continue their deception by sending a fraudulent update to us backers.

We prompt you to

  1. inform all 554 backers of the above testimonies

  2. stop being a partner in crime

  3. publish the contact details of zoommaker so we can take legal actions against him

As we may need to file a class action against you Kickstarter, we legaly have to set you a deadline of 7 days to support us - and no longer the fraud.

We sincerely hope that you rethink your ignorant attitude to your community and help make Kickstarter a better crowdfunding platform :-)

@ALL Zoommaker backers, if you don't want to devise a better text, hit the Report this project to Kickstarter button at the bottom of the campaign description and copy and paste my draft.

If you have already reported Zoommaker, you can contact Kickstarter here: https://help.kickstarter.com/hc/en-us/requests/new

report your progress here and(!) in the comment section !

draft of our campaign description

Hello world of crowdfunding !
We are a 15+ backers of a USD $100.000 fraud on Kickstarter
and we have already raised $330 to put the fraudster to justice
and if necessary file a class action against Kickstarter.

We do NOT fight Kickstarter, we love Kickstarter.
That is why want to make it a better place: (proposals to Kickstarter)
That is why we run our campaign here - alongside with all the frauds
that were allowed to run by Kickstarter.

We will build a worldwide platform to help victims of crowdfunding frauds:

  • how to file a criminal complaint in you country.
  • how to find a lawyer.
  • how to raise money.
  • etc.

So you all might be happy to follow us along.

Please share to all the victims of crowdfunding frauds - there are hundreds of thousands of us !

Why the $100k Zoommaker fraud is special:

  1. There was a very intensive backer effort in the comment section to get this campaign suspended.
  2. When Zoommaker hid his identity with 'We have submitted our company information to Kickstarter by the requirements of the platform. We do not want to publish our company information to avoid malicious targeting by our competitors.'
Kickstarter confirmed this with 'We’ve investigated and determined that it doesn’t violate our rules or community guidelines. ...'.
  3. When later the fraud had become plain obvious and backers asked for the creators contact details to push legal actions, Kickstarter said we need to research the creator before pledging any money and that they don't offer refunds.
    (4. Kickstarter allowed the creator to issue a fraudulent update with old photos.)

our plan (with your help):
Strategy will if we indeed have to enter court, then we have already won because Kickstarter by then has fully proven their ignorant behavior that is fostering fraud:

  • done - set Kickstarter a deadline to hand out Zoommakers contact detail.
  • todo - set Kickstarter a deadline to inform all backers of the fraudulent update #5
  • done - $250 funding from 11 Zoomaker backers.
  • todo - $2.500 campaign on Kickstarter and on a competing crowdfunding platform.
  • todo - ask 4 successful (2+ campaigns) and trusted Chinese creators to ask their 12.322 backers for support.
  • todo - file criminal complaints in three countries to make prosecutors claim Zoomakers contact details from Kickstarter.
  • todo - Verify these contact details in Hongkong to file a criminal complaint there. (only from now on at least several $100 are needed)
  • todo - if contact details are invalid, file a civil action against Kickstarter: compensation for damages / loss suffered.
  • todo - If Kickstarter denies, file a criminal complaint against Kickstarter for partner in crime.
  • todo - File a $30 million civil action against Kickstarter because their system is rigged to allow fraudulent campaigns get away so Kickstarter can keep their commission without damaging their reputation.

Every failing campaign sooner or later gets into the 'scam zone' where they no longer follow the rule of transparency and deceive their backers with fraudulent updates.

When every backer of a failed tech campaign would only donate $1, we could raise a few hundred thousand US dollars !

So our basic strategy is to grow bigger and bigger.

Not to kill Kickstarter but to make it a better place !
We all want crazy campaigns and Kickstarter wants to be "The Wild West Of Crowdfunding" to foster creativity.

But fostering fraud is in itself fraud.

We want to precede so all crowdfunding victims can follow.
That is why put everything open source on Github (the heart of open source)

@ALL, please join to finally make crowdfunding a better place :-)
