Absolutely. You can use the CC2D in any game that you make whether paid or
free. The only restrictions on the CC2D are that it cannot be sold or
distributed as a Unity asset to other Unity developers.

Alright thats great, it would also be nice to know for the future, is it also allowed for me to use the CharacterController2D in an sold asset for an example? For example if I was to make a networking solution would it be allowed to have a 2D example using the Controller? With a link to the github for credit of course.

No, that is not allowed. Distribution is only allowed in a compiled game.
The asset/source can not be distributed.

https://www.assetstore.unity3d.com/en/#!/content/26617 is selling your code (with modifications) in that asset.

they have a class called CorgiController2D and the code is 80% equal to CharacterController2D.

To further expand and clarify on this topic, after creating a commercial (closed source) game using the CharacterController will I then have to release my personal code that builds open or uses the CharacterController? Also in terms of attribution would putting it in the Credits portion of the game be sufficient or even necessary?

When using the CC2D in a game nothing at all needs to be done. No attribution is required and you most certainly don't need to release your source code. You are clear to just make all your games with it!
