A few apps (e.g. Fractal) don't have a gap, but most do have a gap.

I would share a screenshot but the screenshot utility is broken for me right now

It has a gap for me.
Although if there's already a maximized window, maximizing a second one on top leaves no gaps, but when any maximized window is un-maximized or closed, the panel floats even though there are still maximized windows remaining.

I think it's possible this isn't a bug in the panel. It seems to me like the layout of the maximized window doesn't quite adjust to the final size of the maximized panel.

It always has a gap when the panel first maximizes and is configured to have a gap, but if I maximize the same application, minimize it, maximize a second app, then finally activate the first app, there is no gap for the first application, which had a gap before. (This is when testing with the fix for #133
