POST 1 of 4 - Collecting Burners Views.

READ EVERYTHING BEFORE COMMENTING. This is a complex issue which will take time and effort to improve.

This is a community attempt to improve the media capture (taking photos/videos) situation at burns. It is apparent that we have no guidelines around this issue, and as a result, even the best intentioned people end up breaching consent, from capturing to uploading/sharing.

There is the separate issue of media capture breaching immediacy, but this will not be discussed here, as we know people exist who hold both primary opinions on the subject. More importantly, immediacy breaches hinge on our ability to obtain full consent, that means, if everything is fully consented to, whether pre or post capture, we shouldn't be bothered by lenses.

This is the first in a series of posts which will try to reach some useful outcome and produce something to help us all understand the desires of burners. This first post seeks to collect peoples views on this complex subject. The second post will be the same as this first post but with updates incorporated from the meta section, so we all have the chance to contribute at every level. The third post will attempt to collate views on some happy medium. The fourth post will attempt to create a small, easy to follow guide for media capturers which can be provided at burn events. All of this is up for recantation, as per the meta aspect. Each post will stay active for 2 weeks.

Wild Media Capture: A concept that helps simplify the context in which we capture media. In our (theme) camps it is much simpler to control media capture. We can know everybody and it's possible to get full consent of every person. Elsewhere, in the wild, things are very different. Outside our camp, or when our camp is open for play, the task of getting full consent becomes difficult, if not impossible.

What do you think of this concept as part of a guide? Is it easy to understand and useful to guide burners in this space? What other views do you have?

Consent: The big one. Capturing media of anyone without their consent is a big no no. So is using the media in any way which the subjects do not agree to. The grey area here is that some people like spontaneity with their media captures because it is the only way to really capture the moment. This is alleviated by thorough post-capture consent, of every subject in the media. Spontaneous media capturing is linked directly to the immediacy principle and there is no way to know if yet to be consented people like having a lens pointed at them, let alone their image captured. Most can agree that pre consent is totally fine, the main issue here is the spontaneity/post capture consent aspect.

How do you feel about post capture consent? What other views do you have?

Ownership of content: When media is captured of individuals, with full consent, the media capturer has first ownership of the media. This does not mean that the image can be used for commercial reasons without the subjects explicit permission.

Do you understand this legal implication, both as a media capturer and as a subject? Do you think some terms/conditions should be created for burn events which attempt to change this legality? What other views do you have?

Use of content: Once images are uploaded to the internet, intentionally or via backup to storage platforms, they become accessible to hosting providers. Some providers scan images using AI to identify faces and use this data to build profiles of people. Even if they don't currently scan images, they may do so in the future. Providers may have security holes which eventually leak media to malicious agents. Some media capturers may benefit commercially, either directly or indirectly. Family, loved ones or employers may end up seeing media you agreed to be the subject of, but did not agree to be shared.
