binding.xml copied to public folder and then fubu fails with a malformed xml exception

should binding.xml not be excluded from the copy module?

Will reproduce and then give you the stacktrace but basically I have a fubu new app web-app -o spark application which has been updated to 2.0 and had diagnostics installed.
