This is odd because this exact code works on 4.6.1

DateTime.Now is more precise in .NET Core, so two calls to it would be much more likely to produce the same value in .NET Framework.

Are you sure this logic is correct? I assume that last => should be an ==, which means you're evaluating DateTime.Now twice, and it could return two different values each time.

If you're trying to match on the condition where DeletedAt does not have a value, I think you actually want something like .Where(p => !p.DeletedAt.HasValue).
