Check below. If it shows nil, libXML is too old.
With libxml2 version 2.7.3, it shows 'Shift_JIS'.
(Nokogiri uses and returns 3rd argument as it is)
See Nokogiri::VERSION_INFO.
p Nokogiri::HTML.parse('<html></html>', nil, 'Shift_JIS').encoding
(Nokogiri should specify a version of libxml2, I think)

Thanks for the patch, awesome ... I apply it every time I install the gem (so my app won't raise tons of "can't convert nil into String" errors)

This looks to come when using an old libxml release. If you can, update it before patching mechanize itself.
You can use Nokogiri::VERSION_INFO to find your loaded libxml version
