This has been fixed already I believe. You can see here (https://github.com/tangentlabs/django-oscar-paypal/blob/develop/paypal/payflow/gateway.py#L48) that all transactions set this parameter.

So I just tested this again, and reference transactions are still returning an Invalid Tender error. I believe this is because the reference_transaction() method does not _submit_payment_details(), but instead executes the transaction with _transaction(). TENDER does indeed get set at ln48, but since reference transaction don't use it, the transaction gets submitted with no tender value.
