I know this is a closed issue, but I ran into the same issue on a Mac running Mojave 10.14.1.
The issue was caused by already having docker installed when I did the CLI update, reinstalling circleci cli resolved this issue for me.
I also needed to run docker pull circlecli/picard to ensure that this image was on my machine.

The problem was solved by enabling docker to run under simple user, not sudo.
