Android 13 blocks foreground services on app restart unless rare conditions are met, so this is expected. The scan blocks from background startup are likely a Xiaomi power enhancement. I suggest you troubleshoot the second half by simply launching the reference app in the background to a locked phone from ADB on Xiaomi without a foreground service. Look for OS logs about Bluetooth scans bring blocked

Regarding Android 13's blocking of foreground service starts from the background, library version 2.20+ has been updated to fall back to using the Job Scheduler to schedule scans if a foreground service start fails, then the library will retry starting the foreground service later if the app is brought to the foreground. I realize this behavior is not what you want of your project, but this is what Android 12-14 allows. The only other way to ensure a foreground service is allowed given Android restrictions is to send a notification to the user asking them to bring the app to the foreground briefly so the foreground service can start.
